SMS Consent Disclosure

Hearth is the trading name of Kamsi Anienwelu, sole proprietor, Ithaca, New York — the registered brand behind these messages.

This page documents how tenants and lease guarantors consent to receive text messages from Hearth, and the exact disclosure landlords are required to present when they collect a phone number.

How consent is collected

Hearth does not enroll anyone on its own. A landlord enrolls the tenants and guarantors of a property they manage, using the phone number that person provided in writing on their lease or rental application.

Landlords using Hearth are required to include the disclosure below on the lease or rental application, adjacent to the field where the phone number is collected. A phone number collected without this disclosure is not valid consent, and that number must not be enrolled.

Required disclosure language

This is the exact text landlords must present at the point the number is collected:

The same disclosure is presented to a lease guarantor when their number is collected.

Confirmation message

Before any other message is sent, every enrolled person receives a message identifying the property, explaining what the number is for, and stating how to opt out:

Hi Maya — this is the number for 123 College Ave. Text here with anything about the house: rent dates, maintenance, move-out. I'll answer what I can from your lease and pass anything else to Alex. Reply STOP to opt out. How your info is handled: hearthassist.com/privacy.html

If that person replies STOP, the opt-out is recorded immediately and no further automated message is sent to that number by any part of the service.

Landlord obligation

Every landlord accepts, as a condition of using Hearth, that they have presented the disclosure above, that each number was provided by the person it belongs to, and that the person expects communication about their tenancy. This is set out in section 3 of our Terms of Service.
